Sedra Mishpatim 120 words, Humanity is a State of Mind
Killing those found tunnelling into your home is not murder. [22:1]
Halacha asserts that the tunneller’s intention to steal without killing are unrealistic due to the likelihood of confrontation. [Rashi]
Why does the Torah describe the robber as having no blood i.e. he is already dead?
How do our Sages understand the first option is to kill rather than disable the tunneller?
These two questions answer one another: disabling suggests this person can be rehabilitated. The Torah declares in this case there is nothing to salvage, there is no blood, there is no life.
Why or how this tunneller has come to this shocking state is not relevant.
Humanity is not a life form it is a state of mind.
